Terms of Service

These Terms of Service ("Terms") govern your access to and use of waitset ("we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. About Us

waitset is currently operated by individuals and does not yet have a registered legal entity. This page will be updated when that changes. You can contact us via our contact page or email us at waitset [at] harvide [dot] com.

2. The Service

waitset helps you collect and manage waitlist signups. We provide hosted waitlist pages and embeddable forms and track referral and campaign performance. Both plans support custom domains. Templates are fully customizable.

3. Eligibility and Accounts

  • You must be able to form a binding contract in your jurisdiction.
  • You are responsible for maintaining the security of your account and for all activity under it.
  • Email/password sign‑in requires email verification. We also support GitHub OAuth. We do not store plaintext passwords.

4. Customer Content and Hosted Pages

  • You retain ownership of your signup data and content. You grant us a limited license to host, process, and display it solely to provide the Services.
  • You are responsible for the content on your hosted pages and for complying with applicable laws, including collecting consents where required.
  • You may use a custom domain. You are responsible for the DNS changes and for not infringing third‑party rights.

5. Subscriptions, Trials, and Billing

  • We offer paid subscriptions with a 7‑day free trial. When the trial ends, your subscription will start unless you cancel.
  • Subscriptions renew automatically until cancelled.
  • Charges are processed by our payment partners. Taxes may apply.
  • Cancellation takes effect at the end of the current period unless stated otherwise. Refunds are not guaranteed.

6. Acceptable Use

  • No unlawful, deceptive, or harmful activity.
  • No spam, malware, or attempts to disrupt or overload our systems.
  • No infringement of third‑party intellectual property or privacy rights.

7. Analytics and Integrations

We use analytics to improve and secure the Services, including PostHog and a browser fingerprint provided by FingerprintJS (with a fallback anonymous identifier). See our Privacy Policy for details.

8. Third‑Party Services

We rely on third‑party providers (for example, Convex for backend infrastructure, Resend for email, PostHog for analytics, FingerprintJS for device identification, and Autumn and its payment partners for subscriptions). Your use of those services may be subject to their terms.

9. Termination

We may suspend or terminate your access if you materially breach these Terms, pose a security risk, or cause harm. You may export your signup data before closure.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

12. Indemnification

You will indemnify and hold us harmless from claims arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Poland. You agree to the exclusive jurisdiction and venue of the courts located in Poland for any disputes, unless applicable law requires otherwise.

14. Changes

We may update these Terms from time to time. We will post the new Terms on this page with an updated date. If changes are material, we will provide additional notice where required.
